A provincial autonomy bill is being drafted by the National Reconstruction Bureau and Senator Waseem Sajjad . It will be introduced in the Parliament in the beginning of Feb.
While elsewhere on this blog, it has been asked if provincial autonomy can be `presented” in the form of a bill, we thought at least lets get the discussion going on some major issues. The Jan individu -spotlight focuses on the Frontier Crimes Regulation that governs the Federally Administered Tribal Areas to this day in Pakistan.

Provincial autonomy is a bit of a joke considering the failure of WAPDA and the federal government to honour the hydel profits agreement.
Yes . .they ‘re not .In the Northern Areas case, actually the 1999 Supreme Court judgement is also being violated. However, consmetic measures like increasing Balochistan ’s seats by slashing Punjab ’s quota are being taken and then we have statements from the Parliamentary Affairs Minisnter Dr. Sher Afgan ,“Punjab has made this sacrfice but still they are against us” actually sounding more like Bush. . `why do they hate us?” Reminds one of what Senator Asfandyar Wali once said.. “ We are talking about the rights of our provinces and you are telling us that we ‘ll make 20 of your men Grade 17 government employees”
No doubt that the FCR is a draconian law (if it can be called a law..because in my opinion it is a set of instructions for the rulers as to how to continue to rule/manipulate/ keep the local people subjugated without being challenged legally), however there is even a worse situation likely to emerge if the route that is being pursued succeeds- implementation of the Pakistani Law or conversion of FATA into PATA. If any one is suggesting to me that by introducing one of the most corrupted and abused local laws system in the world ‘The Pakistani Law’, the problems of FATA can be solved…they are day dreaming! After all where is that law being implemented in the so called ’settelede areas’ of the country? What is it that was happening in the FATA… before the current war on terror or may be before Zia’s Jehad in Afghanistan started that was and is still not happening in the rest of Pakistan? These areas compared to the rest of the country were more peaceful than the entire country. If any one has doubt..please compare the crime rate of 70s/80s. The problems cropped up when the state started manipulating/radicalizing/islamizing the population of FATA to serve its own interests. Afterall why is it that you allowed and funded and suported the establishment of madrassas in FATA while universities, colleges, schools and industries were being set up in the Punjab and other urban centres of the country? Probably the people needed more islamic education but nothing else! Or probably the a part of the Arab/Gulf money had to be shown to be invested in promoting radical religion!
The problem is not the Laws only..it is the intension/motives behind these laws and the state policies on the region and the people who reside there which need to be changed first. Formulating mere new laws will change nothing. ‘OR IS IT THAT WE ARE WITNESSING A CHANGE OF HEART! OR MAY BE THERE IS A THINKING..LETS FOR A CHANGE GIVE THEM A PIECE OF CAKE TO SEE OFF THE INTERNATIONAL FOCUS…WE CAN GET BACK TO OUR OLD WAYS WHENEVER WE WANT.’ AFTERALL ISN’T THERE A TALK OF DOLING OUT SOME AUTONOMY TO THE PROVINCES?
… but then Fatima what is the solution? You say that the “Pakistani laws” are not an option and there is crime even in the settled areas. Our take on this one is : sure , there is crime in the settled areas. In every city of the world , crime is prevalant. And yes, the implementation of the law in Pakistan as far as rule of law, equality before the law and effective law and order needs drastic improvement but is this enough of a reason to not to seriously consider the option of FATA being incorporated in PATA and becoming a part of NWFP?
The bottom line of Fatima’s argument runs like this: we should not build more schools, hospitals, and roads because the existing one are not delivering. Hospitals have become more places of spread of diseases than cure, roads are not worth travelling, so let us walk on foot etc etc. This is an enlightened logic for regression. And as for the peace cliche used for FATA, my question is: who has done statistics of crimes in FATA to make comparisons. How many crimes are “reported” in FATA. You get statistics from the political agents offices?
I think it is not the matter of only law but also the opertuniy too. Actually what I mean is that Pakistan is not and can never be a country where pushtoon can leaave peaceflly, rather I can say that in other words that the violence in FATA is not a indigineous problem but one created and supported by the state. So Raza Sahib by expanding the machinery of this state to FATA can not solve the problem. It is the best time that we speak about Dawrand Line rather than inforcement of law or exanding the state machinery to FATA. By saying so I mean that if the law of Pakistan is expanded to FATA and if some peace is restored there due to the presence of US and NATO forces in the scene today but when at some times when the world is not very focused in this region Pakistan will one again creat instability in this region. I would liketo explain my point of view other way. The budget of FATA three years ago was only 75 crore while that of NWFP (inspite of federal government grabing of NWFP revenue) was 47 billion where as today this ratio is 9 billion/ 96 billion. The comparative rise in FATA is not out of a good well of NWFP but due to the comparatively stronger government in Afghanistan. So we should never trust Pakistan and hurry up to get more and more of our rights we can or to even break this country. Otherwise like 1992 (after USSR retreat) we will be left in front of these black dogs again bothin Pakistan and Afghanistan.
Very valid points Sir . Pardon my ignorance but isn’t it true that although you say that “Pushtoons cannot live peacefully in Pakistan” Pushtoons of the North West Frontier Province have enjoyed positions of power since the 1950s? In fact after the Punjabis , if there one ethnic community that has , they are the Pushtoons of the NWFP. So , if we follow your line of thought , we can perhaps say that the NWFP Pushtoons are equally responsible for the current situation.
And “strong government ” in Afghanistan ? You mean the government whose Head is protected by American guards? The strong government that is restricted to the green zone of Kabul?
My dear individual, tell me one thing “Was Mr Zafarullah Khan Jamali really the prime minister”, if your answar is yes then I agree to your points. If not then you are saying the same thing as the government that they will increase the quta of balochistan. Actually the real progress of NWFP or any other province can not be insured by having more seats in federal jobs rather it can be insured only by the provincial atonomy. The indicators for develoment of an ethnic group can not be measured from the officers in federal government rather it is measured on the basis of the infrastructure on their own homeland i.e. NWFP, and Balochistan.
I donot need a 20 grade officer in Islamabad but I need my 500 billion from federal government. I want my income from WAPDA, Tobacco. I want schools, Industries and the most important thing “peace” on my land. I do not need empolyment in an industry in sialkot rathe I want a unit of that industry in NWFP too.
Do you know, in 2002 Sarhad Chamber of Commerce prepared a list of 126 items for trade with Afghanistan and central Asian countries but only 4 items were approved out of which no one was from NWFP i.e. Rice, PVC pipes, and the other too I am sorry I donot remeber. Tell me what our people can do in such state of affairs except smagling on our borders. I suggest you to collect the details from Sarhad Chamber about this.
What the image of Pushtoon Pakistan is giving to the world. I request you to go through the recent visit of President Musharaf to US and UK.
Tell me again If Pakistan can not stop taliban to set up a public court in Lachi (Kohat), Bannu and many other places and punish people, then let us solve our problems ourself.
I am sure if I say even a single word against the government I will be certainly killed by agencies, then why they have allowed mullah to do so as they are their agents to divide our society.
Tell me again what this state did with our gaint leaders like Bacha khan abdul wali khan and abdus samad khan achakzai.
